Homewise, Inc. ("Homewise," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use our SMS messaging platform for Homeowners Associations (the "Service").

This Privacy Policy applies to:

  • HOA Customers: Homeowners Associations and property management companies that use our Service
  • Residents: Individuals whose contact information is stored in the Service and who receive messages
  • Website Visitors: Individuals who visit our website

Please read this Privacy Policy carefully. By using the Service or our website, you agree to the collection and use of information in accordance with this Privacy Policy.


1. Information We Collect

1.1. Information Collected from HOA Customers

When an HOA or property management company registers for our Service, we collect:

Account Information:

  • Organization name and address
  • Contact person's name and email address
  • Phone number
  • Billing information (credit card details, billing address)
  • Account credentials (username and password)

Usage Information:

  • Number of messages sent and received
  • Message delivery status and timestamps
  • Features and functionality used
  • Service usage patterns and analytics
  • Technical support interactions

1.2. Information Collected About Residents

When HOAs use our Service to communicate with residents, we collect and process:

Contact Information:

  • Phone numbers
  • Names (when provided by the HOA)
  • Property/unit identifiers
  • HOA community association

Communication Data:

  • SMS message content sent by HOAs
  • Opt-in consent records
  • Opt-out requests and preferences
  • Message delivery receipts
  • Communication timestamps

Important Note: We collect resident information only at the direction of HOA Customers. We do not independently collect resident information.

1.3. Information Automatically Collected

When you use our Service or visit our website, we automatically collect:

Technical Information:

  • IP address
  • Browser type and version
  • Device information (type, operating system)
  • Time zone and location (general geographic area)
  • Usage data and analytics
  • Cookies and similar tracking technologies

Important for Residents: The HOA or property management company that uses our Service controls the resident contact information and message content. We process this information on behalf of the HOA. Residents should contact their HOA directly for questions about how their information is used.

4.3. Business Transfers

If Homewise is involved in a merger, acquisition, sale of assets, or bankruptcy, your information may be transferred to the successor entity. We will provide notice before your information is transferred and becomes subject to a different privacy policy.

4.4. Legal Requirements

We may disclose information when required to:

  • Comply with legal obligations
  • Respond to subpoenas, court orders, or legal processes
  • Enforce our Terms of Service
  • Protect the rights, property, or safety of Homewise, our users, or the public

  • Your HOA controls resident data, not Homewise

For Residents: Contact your HOA or property management company directly, as they control your information.

We will respond to your request within the timeframe required by applicable law (typically 30-45 days).


7. Data Retention

7.1. HOA Account Data

We retain HOA account information for as long as the account is active and for a reasonable period thereafter to:

  • Comply with legal obligations
  • Resolve disputes
  • Enforce agreements
  • Maintain business records

7.2. Resident Contact Information

We retain resident contact information on behalf of HOA Customers for as long as:

  • The HOA maintains an active account
  • Required by the HOA for communication purposes
  • Required by law or for legal defense

When an HOA account is closed, resident data is deleted within 30 days unless we are required to retain it by law.

7.3. Message Content and Logs

We retain SMS message content and delivery logs for:

  • [Specify period, e.g., 90 days to 2 years] for operational purposes
  • Longer periods when required by law or for legal compliance
  • As long as necessary to resolve disputes or support requests

7.4. Deletion Requests

Upon request, we will delete information in accordance with applicable law, except where retention is required for:

  • Enforcing our Terms of Service
  • Defending legal claims

8. Children's Privacy

The Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected information from a child under 18, we will take steps to delete such information promptly.

12. SMS Messaging Privacy

12.1. Message Content

HOA Responsibility: HOAs are solely responsible for the content of messages sent through our Service. We do not control or pre-screen message content.

Our Role: We act as a service provider that transmits messages on behalf of HOAs. We do not use message content for marketing or other purposes beyond providing the Service.

12.2. Consent Management

HOA Responsibility: HOAs must obtain proper consent from residents before sending SMS messages, as required by TCPA and applicable laws.

Opt-Out Processing: We automatically process opt-out requests (e.g., "STOP" messages) and immediately stop sending messages to opted-out phone numbers.

12.3. Carrier Information

SMS messages are transmitted through third-party telecommunications carriers. These carriers may have access to phone numbers and message content as necessary to deliver messages. Carriers are subject to their own privacy policies and terms of service.


13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.

Notice of Changes:

  • We will post the updated Privacy Policy on our website with a new "Effective Date"
  • For material changes, we will provide additional notice via email or Service notification
  • Continued use of the Service after changes take effect constitutes acceptance of the updated Privacy Policy
